The German Bundestag decided in its session on December 17, 2020, to reduce the residual debt discharge procedures from 6 to 3 years. From now on, personal bankruptcies and regular bankruptcies will therefore last a maximum of three years for everyone!
The most important changes in detail: The reduction of the insolvency proceedings to three years is to apply retroactively to all insolvency proceedings filed from October 1, 2020.
For insolvency applications submitted between December 17, 2019, and September 30, a transitional regulation has been established. These insolvency proceedings will be shortened by the time that has passed since July 16, 2019.
For your bankruptcy application from October 1, 2020, the following applies: The debt discharge phase is reduced to three years. A minimum quota is no longer required.
